Half of the class is given a chance to explain what they learned last lesson and how it will connect to the todays lesson. The teacher here is in a position to understand if the student got what she taught. And in most cases, because this class of French every student had a person on it they could not let Kathleen down as they explain. In this lesson, she introduces naming of the objects in French and how the names are pronounced. She gets out a chart with various drawing labeled with their name. In this lesson, the eyes could be seen moving from the chart to teachers and back again. When madam point out an object the eyes could be moved to chart and when pronouncing the name everyone hears are very set to get every bit of pronouncing and eyes could monitor the movement of the mouth as syllables get out. It makes it easy to use the chart for the student will be able to remember the name once they come across any of the objects in daily activities of the student. The class ends with excitement as the madam promises the student of the French class for a trip to view more things and identify their names. They planned to go to an animal park. The day for the next lesson comes in, and the class was attended thoroughly. I think this was because of the promise Kathleen made to her student. She too ready for the learning trip. Everyone is set with a notebook, a pen, a ruler and a pencil. â€Å"Great,† she says as she found out every student was in class in time and set as usual. The students with their teacher board the school bus, and they are taken to the park for the study. Because it could be hard to draw what they all found they were guided to have a table of columns and rows where they could write the name of the object they met in the park in English then aside from the French name. This made it simple for them to understand well as some were not in a position to name some of the objects in English. Being very busy during the day, they found themselves taking meals in the evening as they left the park. Kathleen advised them when they get home, let each one practice all that we learned today as we meet for the ne xt lesson to summarize what we have spent doing today.   The study trip was very nice and everyone including teacher, Kathleen was delighted.

Personally, I remember going to the Milwaukee Art Museum when I went to Wisconsin for spring break and it was one of my favorite parts of the whole trip. Some of my favorite pieces from visiting MAM were Carnaval des Fleurs by Riguad Benoit and View from the Artists Studio by Pierre Bonnard. I love the use of color and they made me appreciate the beauty of the new blooming flowers of springtime. I have also looked into art therapy and its benefits because I suffer from depression, and I found that taking time to paint and draw helped me feel relaxed and peaceful. I took art all four years of high school and it was my absolute favorite class because I didnt have papers and assignments due every night and I could work at my own pace. I remember feeling sat isfaction when I finished a piece or did a really difficult or new art medium that I wasnt used to. I think that different forms of art are a necessary part to becoming a happier person because creating something gives you a new found sense of joy. I also found that being able to share my artistic creations with others and seeing the happiness that my art gave them made me feel happy all over again. Being able to appreciate writing and poetry also brings me happiness. My mom bought me a set of poetry books for Christmas last year and I am currently re-reading them all again. I also like writing poetry and it helps me to sort of map out my emotions when everything in my head seems like a chaotic mess. Music also gives me a happy feeling. Several of the presentations that have been given on music definitely resonated with me because when I listen to happy songs, I feel happier and more motivated. I also like playing my ukulele because it helps me relax when Im stressed. Growing up as a kid, my grandmother had a piano in her living room. I never learned it play it, but as a kid, I liked strumming all the keys and humming little songs. My grandmother also used to sing me twinkle twinkle little star to help me sleep. I feel that being able to understand and appreciate different forms of art also enhance someones freedom and individualism. If someone grows up not knowing how to appreciate art, whether written, painted or musical, they cant appreciate all that life has to offer them. And being able to appreciate them in your own way, makes you the individual you are. I appreciate and see different things in a painting than my best friend would. We are both artistic and smart so we can appreciate the artwork in front of us, but we have different life experiences and central life interests so we see the same piece of artwork differently. So, when you combine the importance of the arts and the effects that they have on freedom and individualism, I feel that they directly affect a persons pursuit of happiness because being able to freely express yourself will allow you a sense of happiness. I know that when I finish a piece of artwork or a poem, I feel accomplished and proud of myself and that makes me feel happy. I think luck plays some part in all of this because if you seek out happiness, you may not find it. But the chance or luck of being able to find happiness is the greatest reward of all, They have no assurance of success, no assurance that happiness is owed to them (Bok p.2). That quote from Exploring Happiness really resonates with me personally because when you suffer from depression, every day is a battle of its own and finding happiness in a bad day, even if it is as simple as watching the sunset, makes all the bad things fade away. What Is an Oral Tradition

The rich and heroic period when the events of the Iliad and the Odyssey took place is known as the Mycenaean Age. Kings built strongholds in well-fortified cities on hilltops. The period when Homer sang the epic stories and when, shortly after, other talented Greeks (Hellenes) created new literary/musical forms—like lyric poetry—is known as the Archaic Age, which comes from a Greek word for beginning (arche). Between these two periods was a mysterious dark age when, somehow, the people of the area lost the ability to write. Thus, Homers epics are part of an oral tradition which passed down history, custom, law, and culture through spoken word rather than written. Rhapsodes: Generations of Storytellers We know very little about what cataclysm put an end to the powerful society we see in the Trojan War stories. Since the Iliad and Odyssey were eventually written down, it should be emphasized that they came out of the earlier oral period, proliferated by word of mouth alone. It is thought that the epics we know today are the result of generations of storytellers (a technical term for them is rhapsodes) passing on the material until finally, somehow, someone wrote it. The specifics of this structure are among the myriad details we dont know from this legendary age. Keeping Culture and History Alive An oral tradition is the vehicle by which information is passed from one generation to the next in the absence of writing or a recording medium. In the days before near-universal literacy, bards would sing or chant their peoples stories. They employed various (mnemonic) techniques to aid both in their own memory and to help their listeners keep track of the story. This oral tradition was a way to keep the history or culture of the people alive, and since it was a form of storytelling, it was a popular form of entertainment. Mnemonic Devices, Improv, and Memorization The Brothers Grimm and Milman Parry (and, because Parry died young, his assistant Alfred Lord, who carried on his work) are some of the big names in the academic study of the oral tradition. Parry discovered there were formulas (mnemonic devices, literary devices, and figurative language still used today) that bards used which allowed them to create part-improvised, part-memorized performances.

Abstract The criminal justice system is a system of law enforcement that is directly involved in prosecuting, defending, sentencing, and punishing people suspected of crime or convicted of felony offenses. Question: Discuss about the Business Law ASIC v Adler. Answer: The brief facts of this case are that in June 2000, HIH Casualty and General Insurance Ltd. (HIHC) gave an unsecured and undocumented loan of $10 million to Pacific Eagle Equity Pty Ltd (PEE). The latter corporation was controlled by Mr. Adler, the trustee of Australian Equities Unit Trust (AEUT). At the same time, he was also acting as the non-Executive Director through Adler Corporation which was a major shareholder of HIH. After getting this credit, PEE also became a trustee of AEUT. The loan of $10 million given by HIHC to PEE was used for HIHC's subscription for 10 million worth AEUT Units. Then PEE purchase shares of HIH worth $4 million on the stock market when these shares were put up for sale by PEE at the loss of $2 million. These shares of HIH were bought by PEE for creating a false impression in the stock market, among the investors of HIH that the company is doing good. Similarly, various unlisted shares were purchased by PEE in technology and communication corporations from the Adler Corporation at a price of $4 million. However, all this proved to be a total loss investment. The amount of $2 million was given under trust by AEUT to Adler. However these dealings have been carried out without informing the board of the company and without taking the approval of the shareholders. In the same way, there was no disclosure made to the board or to the investment committee of HIH. Under these circumstances, the court held that in this case, there has been a breach of directors duties mentioned in the Corporations Act by Adler, particularly the duty mentioned in section 180, 181, 182 and 183. As a result of this conclusion, it was decided by the court that Adler should be prohibited from acting as a director of a corporation for twenty years. Similarly, Williams and one more director of the company were also banned from acting as the director for 10 years. Apart from it, penalties were also imposed by the court. Therefore, a penalty of $450,000 was impose d on Adler. A similar penalty was imposed on Adler Corporation. Williams had to pay a penalty of $250,000 and in the same way the other director Fodera was required to pay a penalty of $5000. Apart from it, Adler, Adler Corporation and Williams were also ordered by the court to pay a sum of $7,986,402 to HIHC. The facts of ASIC v Adler were not only very exceptional, but they were also very complicated. The reason was that in this case, there was involved a number of breaches of the duties of directors prescribed in the Corporations Act. It also needs to be mentioned that the collapse of HIH was the result of very bad corporate governance. These breach of duties included the breach of section 180, which prescribes the duty to act with care and diligence; section 181 that imposes a duty on the directors to act in good faith; s 181(2), which prescribes the business judgment rule as a defense to the directors; s182 which prohibits the improper use of position by the directors; s183 according to which the directors should refrain from improperly using any information received by them consequently of their position in the corporation and s 260A related with financial assistance (Ford and Austin, 1995). In this case, it was held by Santow J that HIH, and its totally owned subsidiary HIHC, as well as the directors of HIH, Adler, Williams and Fodera were liable for the breach of related party provisions mentioned in Chapter 2E, Corporations Act plus the financial assistance provisions that are present in Part 2J.3 when a loan was given by HIHC to a trust that was under the control of the entities related with Adler and at the same time, some of this money was used for purchasing the shares in HIH. At the same time, the court also found these three directors liable for the breach of their duties as the directors/officers of HIH and HIHC under Division 1, Part 2D.1 regarding their involvement in the above-mentioned intransigence, the buying of shares by the trust in some unlisted Internet and technology companies from the entities that were related with Adler and the loans given by the trust to some other companies that were linked with Adler. In this case, it was held by Santow J. that s208 has been breached by HIH and HIHC due to the reason that the sum of $10 million to PEE can be treated as providing a financial benefit to PEE and also to Adler Corporation and Adler, falling under s229. The court also stated that for the purpose of the exception provided in s210, the terms of the financial benefits cannot be considered an arms length. This conclusion was made, irrespective of the fact whether the initial payment to PEE was made as an unsecured loan or as the resulting trust, as was argued by Adler. Moreover, in the same way, the court held that the subsequent entering into of the trust deed, cannot be treated to be within the arms length exception mentioned in s210 because there were no adequate safeguards in the trust deed in case where a potential conflict of interest was present on the part of Adler and it was considerably one-sided against the company. In this regard, the court stated that the factual evidence produced in the court was in favor of the conclusion that this transaction was performed at the initiative of Adler and also with the concurrence of Williams. As a result, the court concluded that both these directors were liable for the breach of s209(2) as they were involved in bridging the provisions of s208 by HIH and HIHC. Under the circumstances, it was stated by Santow J that on the basis of the evidence presented in this case, it can be said that the other director, Fodera can also be held liable for the breach of s209(2) due to the reason of his involvement in the breach of s. 208 by HIH. The court noted the fact that he had adequate knowledge regarding the essential elements of the breach and the attempts made by him later on to distance himself from the transaction did not alter this position though we tried to refer matters to others. In this case, it was also stated by the court that Adler had breached his duty of care and diligence that has been mentioned in section 180. According to this section, a director or an officer of the company has to use their powers with same care and diligence that any other reasonable person would have used. Apart from being reasonable person test, s180(2) contains the business judgment rule, which can be used by the directors for the purpose of complying with their duty of care and diligence (Farrar and Hannigan, 1998). Therefore, when the directors are going to make a business judgment, it can be considered that they have complied with this duty if the business judgment has been made in good faith and proper purpose and at the same time it is also necessary that the director did not have any personal interest in it (Paterson and Ednie, 1976). On the basis of the facts of this case, the court stated that at that can be held liable for the breach of his duty to exercise care and diligence, because any reasonably careful director in the same position would not have permitted to pay $10 million to PEE that were going to be used for purchasing the shares of HIH. At the same time, the proper corporate procedures and safeguards have been bypassed by Adler. As a result, the court stated that Adler cannot rely upon the protection provided by the business judgment rule. Due to the reason that it was clear that in this case, Adler had a personal interest due to the fact of a significant shareholding in HIH and as a result, it can be said that the business judgment was not made by a very good faith. These facts clearly revealed that the object of Adler. Behind this transaction was to support the share price of HIH. Therefore, in the end, it can be stated that this case needs to be considered in perspective and the debacle caused by the breach of duties by the directors can be explained with the help of agency theory. After all, the directors are also human beings and they have their own aspirations. Therefore, sometimes there can be a conflict of interest with their fiduciary duties.
